TERMS AND CONDITIONS

By uploading your content (the “Content”) via our website you confirm and agree to the following.

– You are 18 years of age or older;
– you own and/or control the rights to the Content;
– you have permission from any person(s) appearing in the Content to grant the rights herein; and
– Vitamin Wells use of the content does not infringe the right of any third party or violate any law.

The terms and conditions in this agreement apply to Vitamin Well AB’s (“Vitamin Well”, “us” or “we”) use of any words, pictures, images, data, information or any other ‘user-generated content’ that you upload on our website.

You grant us and our affiliated companies (the “Vitamin Well Group”) a royalty-free, perpetual, irrevocable, worldwide license to edit and use your content (photograph/video/caption/text, etc.) uploaded on our website, for the purpose of marketing and advertising our different products under our different brands (including Vitamin Well, NOCCO/No Carbs Company, Barebells and NOBE aloe vera), both in digital and print media, including but not limited to webpages, third party platforms (such as Instagram and Facebook), retailer sites, third party sites and stores.  This license may also be transferred to or and shared with a third party, such as authorized distributors and retailers.

This license agreement also includes a right, but not an obligation, for us to use your username, real name, image, geo location and/or other identifying information in connection with any use of the Content.

Your warranty means that you shall indemnify, defend and hold Vitamin Well and any person acting on Vitamin Wells behalf harmless from and against any claims, damages, liabilities and costs and in connection with the agreed use of the Content and this license agreement, as described above.

This agreement is governed by Swedish law.

Personal Data

You are aware that when you upload Content via our website, we will collect and process personal data about you in the form of photos and related information, such as IP address, email address and name.

Vitamin Well AB  is the controller of your personal data and is committed to safeguarding your privacy and to processing your personal data in a transparent, secure and legal manner.

The legal ground for processing your personal data is to fulfill this agreement with you. The purpose of the processing is to market our different products and brands, and we will cease to use and erase the data when that purpose is no longer relevant.

We may share your personal data within the Vitamin Well Group, with third party collaborators, such as authorized distributors and retailers in accordance with our rights in this license agreement. Such third party collaborators may be located outside the EU. We will not use your personal data for any purpose that is incompatible with the below purposes. Any transfer of personal data outside the EU/EEA (including transfers to our group companies, distributors or service providers located outside the EU/EEA) will be made in accordance with applicable data protection laws and will be based on our fulfillment of the present agreement or on the EU Commission’s standard contractual clauses.

You have several rights that you may invoke as a data subject. For one, you have a right to know what personal data we hold about you. You may also request that we rectify inaccurate data on you and that we erase certain data or information that is no longer necessary for the purposes for which it was collected. You always have the right to lodge a complaint with the relevant supervising authority in your jurisdiction. You may ask us to restrict our processing of your personal data, but please note that such a request may mean that we cannot fulfil our obligations towards you.
